Department of Education exceeded its authority in developing and applying guidelines for purpose of implementing section of Charter School Law (CSL), which required that a school district that has any resident student enrolled in a charter school pay the charter school for each enrolled student, where guidelines instructed school districts to implement in mid-year recalculated and revised rates based upon district’s actual expenditures for the prior school year, which CSL section at issue provided that charter schools would be funded by districts in 12 equal monthly payments, as determined in reference to the district’s budgeted expenditures for the prior school year.
